These Terms of Service ("Terms") govern your use of the products, services, software, hosting services, websites, licensing services, and other services provided by ClassTech Development ("ClassTech", "we", "us", or "our").
By purchasing, accessing, downloading, installing, or using any ClassTech service, product, software, bot, hosting service, website, or other offering, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use or purchase ClassTech Services.
1. Definitions
For the purposes of these Terms:
- "ClassTech", "we", "us", or "our" means ClassTech Development.
- "Customer", "you", or "your" means the individual, organisation, business, Discord server, or other entity using or purchasing a ClassTech Service.
- "Services" means any software development, hosting, licensing, support, maintenance, infrastructure, or other service provided by ClassTech.
- "Software" means any application, Discord bot, script, website, API, system, or other software supplied by ClassTech.
- "Subscription" means a recurring or fixed term payment for continued access to a ClassTech Service.
- "License" means the permission granted by ClassTech to use Software subject to these Terms and any applicable product specific terms.
- "Hosting Services" means hosting, server, bot hosting, application hosting, or other infrastructure services provided by ClassTech.
2. Acceptance of Terms
By using our Services, you confirm that:
- You have read and understood these Terms.
- You agree to comply with these Terms.
- You have the legal capacity to enter into an agreement with ClassTech.
- Any information supplied to ClassTech is accurate to the best of your knowledge.
- You will comply with all applicable laws and regulations.
If you accept these Terms on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
3. Services
ClassTech may provide, including but not limited to:
- Discord bots and integrations.
- Software licensing.
- Web development.
- Custom software development.
- Bot hosting.
- Application hosting.
- VPS and infrastructure services.
- APIs and associated services.
- Software updates and maintenance.
- Technical support.
- Other digital products and services.
ClassTech reserves the right to modify, suspend, replace, or discontinue any Service where reasonably necessary.
4. Accounts and Access
Where a Service requires an account, you are responsible for maintaining the security of your account and any credentials associated with it.
You must not:
- Share account credentials with unauthorised individuals.
- Allow other people to use your account where the Service is licensed to a single user or organisation.
- Attempt to bypass authentication or access controls.
- Attempt to gain unauthorised access to ClassTech systems.
- Provide false or misleading account information.
- Allow another person to access a Service in breach of its licence restrictions.
You are responsible for activity conducted through your account unless you can demonstrate that the activity occurred without your authorisation despite reasonable security measures.
5. Software Licences
Unless expressly stated otherwise, ClassTech Software is licensed to you and is not sold to you.
Subject to payment and compliance with these Terms, ClassTech grants you a limited, non-exclusive, non-transferable, revocable licence to use the Software for its intended purpose.
Unless expressly authorised by ClassTech, you must not:
- Resell or redistribute the Software.
- Copy or reproduce the Software.
- Share licence keys or licence credentials.
- Modify, reverse engineer, decompile, or disassemble the Software.
- Remove copyright, branding, licensing, or attribution notices.
- Attempt to circumvent licensing or activation systems.
- Use the Software to provide an unauthorised commercial service to third parties.
- Extract, reproduce, or replicate proprietary components of the Software.
- Attempt to obtain source code that has not been provided to you.
- Circumvent technical restrictions imposed by ClassTech.
Additional licence conditions may apply to individual products.
6. Custom Development
Where ClassTech agrees to develop custom software for a Customer, the scope of work, functionality, price, timescales, and other requirements may be agreed separately.
Unless otherwise agreed in writing:
- Development work is limited to the agreed specification.
- Additional functionality may incur additional charges.
- Changes requested after development has commenced may affect delivery times.
- ClassTech is not responsible for delays caused by the Customer failing to provide required information, access, content, or approvals.
- ClassTech may use third-party services where reasonably required to provide the agreed functionality.
- Features not specifically included in the agreed specification are not automatically included.
Unless explicitly transferred in writing, ClassTech retains ownership of its underlying code, frameworks, libraries, tools, systems, templates, and reusable components.
7. Hosting Services
Where ClassTech provides Hosting Services, the Customer is responsible for the content, applications, software, scripts, files, and other material deployed to their hosting environment.
Customers must not use ClassTech Hosting Services to:
- Conduct illegal activity.
- Distribute malware.
- Conduct phishing or credential theft.
- Launch attacks against other systems.
- Operate botnets.
- Conduct unauthorised cryptocurrency mining.
- Host content that violates applicable law.
- Deliberately interfere with the operation of ClassTech infrastructure.
- Consume unreasonable resources in a manner that negatively affects other customers.
- Attempt to bypass resource limitations.
- Conduct unauthorised port scanning or network attacks.
- Operate services that intentionally disrupt ClassTech infrastructure or other customers.
ClassTech may suspend a Hosting Service where necessary to protect infrastructure, other customers, or third parties.
Unless expressly included in the purchased Service, automatic backups are not provided.
Customers are responsible for maintaining their own backups where required.
ClassTech does not guarantee that data stored on a Hosting Service can be recovered following deletion, corruption, hardware failure, software failure, suspension, or termination.
8. Service Availability
ClassTech aims to provide reliable Services but does not guarantee uninterrupted availability except where specifically covered by the Service Level Agreement in Section 9.
Services may occasionally become unavailable because of:
- Planned maintenance.
- Emergency maintenance.
- Hardware failure.
- Software failure.
- Network failure.
- Data centre or infrastructure issues.
- Third-party service outages.
- Cybersecurity incidents.
- Events outside ClassTech's reasonable control.
Where reasonably possible, ClassTech may provide advance notice of planned maintenance.
9. Service Level Agreement
For eligible ClassTech Hosting Services, ClassTech targets a monthly uptime availability of 99%.
9.1 Uptime Commitment
ClassTech will use reasonable efforts to maintain at least 99% monthly uptime for eligible Hosting Services.
A 99% monthly uptime target permits approximately:

Uptime is measured against the relevant hosting service and its underlying infrastructure using ClassTech's monitoring systems or other reasonable monitoring data.
9.2 Exclusions
Downtime will not normally count towards the monthly downtime calculation where it results from:
- Scheduled maintenance where reasonable notice has been provided.
- Emergency maintenance required to protect infrastructure, customers, or data.
- Issues caused by the Customer, including configuration, software, scripts, plugins, applications, or other content installed by the Customer.
- Distributed denial of service attacks or other attacks originating outside ClassTech's infrastructure.
- Failures or outages affecting third-party services or infrastructure outside ClassTech's reasonable control.
- Internet service provider, DNS, routing, or connectivity issues outside ClassTech's infrastructure.
- Suspension of a Service resulting from a breach of these Terms.
- Events beyond ClassTech's reasonable control, including major infrastructure, utility, or data centre failures.
- Planned migrations or infrastructure changes where reasonable notice has been provided.
- Incorrect configuration or misuse of the Service by the Customer.
9.3 Monitoring
ClassTech may use automated monitoring and internal infrastructure data to determine Service availability.
Where there is a discrepancy between third-party monitoring and ClassTech's infrastructure monitoring, ClassTech may review the available evidence and determine the applicable uptime calculation reasonably and in good faith.
9.4 SLA Remedies
The 99% uptime commitment is an availability target and does not constitute a guarantee that the Service will never experience downtime.
Unless otherwise agreed in writing, failure to meet the 99% monthly uptime target does not automatically entitle the Customer to a refund, credit, compensation, or termination of their Service.
ClassTech may, at its discretion, provide service credits or other remedies where a significant SLA failure has occurred.
Nothing in this section limits any rights that cannot legally be excluded.
9.5 SLA Claims
Where a Customer believes that the applicable uptime target has not been met, they may contact ClassTech Support with details of the relevant outage.
Any SLA claim should be submitted within 14 days of the end of the month in which the alleged SLA failure occurred.
ClassTech may request reasonable information to verify the claim.
10. Third Party Services
Some ClassTech Services may depend on third-party services, platforms, APIs, infrastructure providers, payment processors, Discord, Cloudflare, hosting providers, or other external services.
ClassTech is not responsible for outages, changes, restrictions, suspensions, or failures caused by third parties.
Changes made by third-party platforms may require ClassTech to modify, restrict, or discontinue functionality.
Where a third-party service is required for a ClassTech Service to operate, ClassTech does not guarantee that the third party will continue to provide the required functionality.
11. Payments
All prices are stated in the currency displayed at the time of purchase unless otherwise specified.
Customers are responsible for providing accurate billing information.
Where a Service operates on a recurring subscription basis, the Customer authorises the applicable payment provider to charge the agreed amount at the relevant billing interval.
Failure of payment may result in suspension or termination of the affected Service.
ClassTech reserves the right to change future pricing. Where reasonably applicable, Customers will be notified before a pricing change takes effect.
12. Refunds
Unless otherwise stated for a particular Service, payments are generally non-refundable once the Service has been provisioned, activated, delivered, or otherwise made available to the Customer.
Refunds may be considered where:
- ClassTech is unable to provide the purchased Service.
- A duplicate payment has been made.
- ClassTech agrees to issue a refund.
- A refund is required by applicable law.
Nothing in these Terms removes or limits any statutory consumer rights that cannot legally be excluded.
For custom development, deposits or payments for completed development work may be non-refundable where permitted by law.
13. Chargebacks and Payment Disputes
Customers should contact ClassTech before initiating a payment dispute or chargeback where they believe there is an issue with a purchase.
Unauthorised or fraudulent chargebacks may result in suspension of associated Services while the matter is investigated.
ClassTech reserves the right to provide relevant transaction and account information to the applicable payment provider when responding to a payment dispute.
14. Acceptable Use
You agree not to use ClassTech Services in a manner that:
- Breaks applicable law.
- Facilitates criminal activity.
- Attempts to compromise the security of another person or system.
- Distributes malicious software.
- Attempts to bypass ClassTech security or licensing mechanisms.
- Abuses ClassTech infrastructure.
- Interferes with other customers' Services.
- Infringes intellectual property rights.
- Fraudulently obtains Services.
- Attempts to circumvent a suspension or termination.
- Deliberately causes excessive or unreasonable resource consumption.
- Attempts to disrupt or damage ClassTech systems.
ClassTech may take reasonable action where misuse is identified.
15. Intellectual Property
Unless otherwise agreed in writing, ClassTech retains ownership of its trademarks, branding, source code, software, documentation, systems, designs, and other intellectual property.
Nothing in these Terms transfers ownership of ClassTech intellectual property to a Customer.
Customers retain ownership of content and materials that they provide to ClassTech, subject to any licence required for ClassTech to provide the Services.
Where third-party intellectual property is incorporated into a Service, that intellectual property remains subject to the relevant third-party licence.
16. Security
Customers must not attempt to compromise, bypass, disable, or interfere with the security of ClassTech systems.
This includes attempting to:
- Bypass licence validation.
- Circumvent authentication.
- Exploit vulnerabilities for malicious purposes.
- Access another customer's data.
- Access systems without authorisation.
- Interfere with security mechanisms.
- Disable monitoring or security systems.
- Obtain unauthorised administrative access.
Security vulnerabilities may be responsibly reported to ClassTech.
17. Support
Support availability depends on the Service purchased.
ClassTech does not guarantee a specific response time unless a Service explicitly includes a guaranteed response time or support agreement.
Support may be provided through Discord, email, ticket systems, or other designated channels.
ClassTech may refuse support requests that require assistance with prohibited, illegal, or unsupported use of a Service.
18. Suspension and Termination
ClassTech may suspend or terminate a Service where:
- The Customer breaches these Terms.
- Payment is overdue.
- The Service is being used unlawfully.
- The Service presents a security risk.
- The Customer attempts to circumvent licensing.
- The Customer abuses ClassTech infrastructure.
- Suspension is required to comply with a legal obligation.
- The Service has been discontinued.
- The Customer engages in fraudulent activity.
- The Customer creates a material risk to ClassTech or another customer.
Where appropriate, ClassTech may provide the Customer with an opportunity to resolve the issue before termination.
Serious security, fraud, abuse, or legal issues may result in immediate suspension or termination.
19. Effect of Termination
Following termination:
- Access to the affected Service may be removed.
- Software licences may cease to be valid.
- Hosting resources may be deleted following any applicable retention period.
- Outstanding amounts may remain payable.
- Customers must cease using terminated licensed Software.
- Clauses intended to survive termination will continue to apply.
Customers should retrieve any data they require before a Service is terminated.
20. Data and Privacy
ClassTech may process personal information where reasonably necessary to provide its Services.
Personal information will be handled in accordance with the applicable ClassTech Privacy Policy and applicable data protection legislation.
Where ClassTech uses third-party providers to deliver Services, relevant information may be processed by those providers where necessary.
Customers are responsible for ensuring that any personal data they upload or process through ClassTech Services is handled lawfully.
21. Disclaimer
ClassTech Services are provided on an "as available" basis except where expressly covered by an applicable SLA or other written agreement.
To the extent permitted by law, ClassTech does not guarantee that:
- A Service will always be available.
- Software will be completely free from errors.
- Software will work with every third-party platform or environment.
- A third-party platform will continue to support required functionality.
- A Service will meet requirements that were not included in the agreed specification.
- Customer data will never be lost, corrupted, or inaccessible.
Nothing in this section excludes statutory rights that cannot legally be excluded.
22. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Subject to this, ClassTech will not be liable for indirect or consequential losses, including loss of profits, revenue, business opportunities, goodwill, or data, except where such liability cannot legally be excluded.
ClassTech's total liability arising from a particular Service will, to the extent permitted by law, be limited to the amount paid by the Customer for that Service during the applicable period giving rise to the claim.
Nothing in these Terms affects statutory rights that cannot legally be excluded.
23. Indemnity
To the extent permitted by law, you agree to compensate ClassTech for reasonable losses, claims, liabilities, and expenses arising from:
- Your unlawful use of the Services.
- Your breach of these Terms.
- Your infringement of another person's intellectual property or other rights.
- Content or software supplied by you that causes a claim against ClassTech.
This section does not apply to the extent that the relevant loss was caused by ClassTech's own unlawful act or negligence.
24. Changes to These Terms
ClassTech may update these Terms from time to time.
The updated version will be published through an appropriate ClassTech website or service.
Where a material change affects an ongoing Service, ClassTech may provide reasonable notice where appropriate.
Continued use of the Service after the updated Terms take effect constitutes acceptance of the updated Terms, subject to applicable law.
25. Governing Law
These Terms are governed by the laws of England and Wales.
Subject to any mandatory consumer rights or other applicable legal requirements, disputes relating to these Terms will be subject to the jurisdiction of the courts of England and Wales.
26. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
27. No Waiver
Failure by ClassTech to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision or any other provision in the future.
28. Assignment
You may not transfer or assign your rights or obligations under these Terms without the prior written consent of ClassTech.
ClassTech may transfer or assign its rights and obligations where reasonably necessary to operate, restructure, sell, or transfer the relevant Service or business, subject to applicable law.
29. Entire Agreement
These Terms, together with any applicable product-specific terms, service agreements, licences, order details, Privacy Policy, and other policies referenced by ClassTech, constitute the agreement between ClassTech and the Customer regarding the relevant Service.
Where there is a conflict between these Terms and a specific written agreement for a Service, the specific agreement will take precedence to the extent of the conflict.
